Wholesale Terms and Conditions

These terms and conditions of sale are an integral part of all contracts entered into by the seller. They apply upon conclusion of the contract or issuance of an invoice, which the buyer confirms by signing the contract or invoice. The buyer's terms and conditions do not apply unless otherwise agreed in writing. The nursery conducts wholesale sales Monday through Friday, from 8:00 a.m. to 4:00 p.m.

Minimum wholesale and transport

The minimum wholesale purchase amount is PLN 2,000, with a minimum quantity of 10 plants of each variety in 2-liter or 3-liter pots, or 5 plants of each variety in 5-liter pots, and a minimum of 3 grafted plants. When purchasing larger quantities, please arrange an estimated pickup a few days in advance. The nursery does not provide transport services. For full truckload orders, we arrange free transport within Poland. We offer packaging on pallets, box pallets, and double-decker pallets (similar to Danish trolleys, but made of wood), which protects the plants during transport. Loose loading of stacked plants is also possible upon request. We also ship plants via courier at the customer's expense.

Prices

The prices presented in the price list are wholesale net prices. VAT is added to the RR invoice. Please note that we are not VAT payers. The listed list prices do not include shipping, packaging, or plant labeling costs. We offer a discount to customers who purchased goods for PLN 5,000 last year and to new customers who made purchases over PLN 5,000 this year. We reserve the right to change prices during the offer period.

Customers can pay in cash or by bank transfer before receiving the goods. Regular customers can receive deferred payment if they make early payments on time and receive our company's consent to use this payment method. Failure to meet the payment deadline will result in the customer losing any discount.
The Seller provides a quality guarantee; however, the Seller assumes no responsibility for the establishment, growth, or flowering of purchased plants, as this is related to external factors beyond their control. All advice is provided to the best of their knowledge and without assuming any liability for its implementation or consequences.
Varieties marked with the PBR symbol in the catalog and on documents (e.g., invoices, delivery notes, etc.) are legally protected. These varieties are entered in the Register of Exclusive Variety Rights maintained by COBORU or protected by the Community Plant Protection Office (CPVO). Therefore, the buyer agrees not to propagate them or have them propagated, and to cultivate and sell them under the name provided by the breeder. Propagation of legally protected plants is only possible under a license agreement.
On the basis of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as 'GDPR'), on the basis of Article 13 paragraphs 1 and 2 and Article 14 paragraph 1 and 2 GDPR KAŁUZIŃSKI GRAFTED PLANTS with its registered office at Boczki-Parcela 14, 98-240 Szadek, NIP 771-174-85-41 designates a contact person in the above-mentioned matter: E. Your personal data will be stored for the period of sending commercial or marketing information by the Controller or until you withdraw your consent to the processing of data for this purpose. Your personal data may be transferred only to authorized individuals (employees or service providers) if necessary to send commercial or marketing information and to fulfill orders while maintaining security standards. You have the right to access, rectify, erase, or restrict the processing of your personal data. We obtain your data only from official, publicly available sources.
